1. Acceptance of Terms
By accessing or using the Kodaloka platform (“Service”), you agree to be bound by these Terms and Conditions. If you do not agree to all of these terms, you may not access or use the Service. These terms apply to all visitors, users, developers, and anyone who accesses or uses the Service.
2. Description of Service
Kodaloka provides a managed WordPress hosting platform designed for developers. The Service includes WordPress hosting infrastructure, deployment tools, staging environments, monitoring, and a developer dashboard for managing client websites. Kodaloka may update, modify, or discontinue features of the Service at any time with reasonable notice.
3. User Accounts and Obligations
To use certain features of the Service, you must create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activities that occur under your account.
- Providing accurate and complete registration information.
- Ensuring that your use of the Service complies with all applicable laws and regulations.
- Not using the Service to host content that is illegal, harmful, or infringes on the rights of others.
4. Acceptable Use
You agree not to use the Service to:
- Host, distribute, or transmit malware, spam, or any malicious code.
- Engage in any activity that disrupts or interferes with the Service or its infrastructure.
- Attempt to gain unauthorized access to any part of the Service or its related systems.
- Use the Service for any purpose that is unlawful or prohibited by these terms.
5. Intellectual Property
The Service and its original content, features, and functionality are owned by Kodaloka and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any content you upload or create using the Service. By using the Service, you grant Kodaloka a limited license to host and serve your content solely for the purpose of providing the Service.
6. Payment and Billing
Certain features of the Service require payment of fees. All fees are quoted in Indonesian Rupiah (IDR) unless otherwise stated. You agree to pay all applicable fees and taxes. Subscription fees are billed in advance on a monthly basis. Failure to pay may result in suspension or termination of your account.
7. Limitation of Liability
To the maximum extent permitted by law, Kodaloka shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or in connection with the Service. Our total liability for any claim arising from the Service is limited to the amount you paid for the Service in the 12 months preceding the claim.
8. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service ceases immediately. You may also terminate your account at any time by contacting us. Termination does not relieve you of any obligation to pay outstanding fees.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Indonesia.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on the Service and updating the “Last updated” date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
